Interviewer:

What exactly does criminal law include or encompass?  In other words, what types of issues do you deal with?

Dustin:

In the area of criminal law, I routinely deal with bond hearings, DUI – 1st offense matters (including administrative hearings regarding license suspensions stemming from an alleged refusal to “blow” and those involving “blowing” 0.15 or higher), domestic violence matters (all degrees), drug offenses (including possession, distribution, trafficking, etc.), state level misdemeanor charges, and state level felony charges.  These are types of matters that are “heard” or “tried” in the Summary Courts (Magistrate and Municipal Courts) and General Sessions Courts of South Carolina, such as in Hilton Head Island Municipal Court (Summary Court), Beaufort County General Sessions Court, and Jasper County General Sessions Court.

Interviewer:

Are you experienced in DUI, Domestic Violence, and other Criminal Law cases?

Dustin:

I have been practicing DUI law, Domestic Violence defense (formerly Criminal Domestic Violence – prior to June of 2015), and general state level criminal defense law since starting this firm in 2008. My practice is primarily concentrated in DUI, domestic violence, and other criminal law cases. These are the areas of law that I choose to do.  I am thankful that numerous firms throughout the area refer criminal law matters to me, and I was formerly selected as a contracted conflict attorney for South Carolina criminal law cases (essentially I handled criminal law cases in which the Public Defender’s Office had a conflict of interest), which provided me with a great deal of experience in complex felony matters.  I do some personal injury and family law work, but most of it is DUI, Domestic Violence defense, and criminal defense because I want to be able to concentrate my practice in a certain area to gain a lot of knowledge and experience in that area and to do an exceptional job for my client.  So, these are the areas that I practice in.  I have had the opportunity to represent people ranging from business executives, small business owners, and professional athletes, and I feel that I am good at it.  These are the areas where I feel I can give my highest and best use and value to people.

Interviewer:

Why do you not practice in all areas, like a “general practitioner” or expand your practice to cover more areas of law?

Dustin:

Criminal law has its own set of rules, time deadlines, issues, and quirks.  If I have learned anything from practicing in this area and in my life experience, it is that my client’s problems are not general – my clients want and need an attorney whose legal knowledge is not general.  A close friend of mine had a pretty major medical surgery when I was 16 – the first surgeon my friend went to was a general surgeon.  Fortunately my friend did not like when the general surgeon said he did not really “do” what my friend likely needed done, but he “really enjoyed that area” and looked forward to the opportunity.  My friend could not get out of there fast enough.  The doctor who ultimately performed my friend’s surgery limited his practice to only the area of the body my friend had the issue with – that doctor told my friend after only very initial tests (that the general surgeon did not even mention or order) that if the general surgeon would have performed the surgery at that time in the proposed manner, my friend likely would have had permanent damage or could have even died.  My close friend did not need or want a generalist – this matter was important to my friend, so my friend wanted someone who worked in the area every day. Since I was 16, I have been determined to never put someone in that predicament if I can help it.  I turn down a huge amount of matters outside of my practice areas, but my clients’ lives and issues are simply too important to me to jump into simply as an experiment.

What is your personal approach to handling DUI, Domestic Violence (DV), and other criminal cases?

Dustin:

My approach is that the focus needs to be on the client.  I think it is extremely important for clients to know that when hiring an attorney to represent you.  If you are hiring a person to handle your case, you should expect a good experience.  You should expect that the attorney is going to be professional.  You should expect that if you call the attorney, he or she will call you back in a timely fashion.  You should expect that the attorney is going to do his or her best to diligently represent you and to look into your case.

I try to put myself in the mind of a client and if I am calling an attorney, I want that attorney to call me back.  I want that attorney to speak to me respectfully and to answer my questions if I pay them to do so.  I want the attorney to work his or her absolute best to help me.

I try to keep that same approach when I am looking at a case. I always put myself in the mind of the client.  I think you should be able to get good value out of your attorney.  You should expect the attorney to be professional and competent.

Do I have to physically come in to your office or may I setup a telephone consultation?

Dustin:

I have actually found that telephone consultations can be quite beneficial.  I like to find out what my clients are going through and help them.  Telephone consultations allow me to speak with a person while he or she in the comfort of his or her own space without the added pressure and time expense of coming to my office.

Usually after a telephone consultation most clients feel comfortable enough to go ahead and hire us.

Some clients of course want to come in and meet with me one-on-one, so we have always offered in-office consultations as well.  Either way, we try our best to offer same-day or next-day consultations to those who request them.
